Biden’s Immigration Agenda

James • Jan 15, 2021

Between political administrations, immigration policy is one area that tends to see a lot of change. As President, Joe Biden has promised to make many changes to immigration policy. He has stated that he will forcefully purse policies that protect national security while still providing a fair and just immigration system that will continue to grow the economy of the United States. Biden’s immigration agenda seeks to undo many of Trumps immigration policies and focuses on welcoming immigrants through a commitment to asylum seekers and refugees while simultaneously tacking the root causes of undocumented immigration.

Biden’s immigration plan includes family reunification and shorter stays in detention facilities. Biden also seeks to reverse Trump’s public charge rule, allowing immigrants to access benefits such as SNAP (Supplemental Nutrition Assistance Program) or Medicaid without fear of immigration consequences. Additionally, Biden wishes to restore asylum options for victims of domestic violence.

One of the biggest pillars of Biden’s immigration plan is the full reinstatement of DACA (Deferred Action for Childhood Arrivals), a program that protects undocumented immigrants brought to the United State as children. In addition to DACA, Biden is calling for an immediate review of Temporary Protected Status (TPS). TPS is a temporary status given to eligible nationals of designated countries who, due to conditions in the country, are given status until able to return safely. Biden ultimately hopes to work with Congress to create a roadmap to citizenship for undocumented immigrants that have been present in the United States for many years. The next four years are sure to see a lot of change in immigration policy. If you’d like to discuss how the change in administration affects your immigration options, please call our office to schedule a free consultation.
